Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and FamRight LLC ("FamRight," "we," "our," or "us") governing your access to and use of the FamRide mobile application ("FamRide" or the "App"). By accessing or using FamRide, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, you must not use FamRide.

FamRide is a private, family-only ride coordination platform operated by FamRight LLC. It allows families to schedule, assign, track, and complete rides among registered family members. FamRide is NOT a commercial transportation service, taxi service, or rideshare platform. FamRight LLC does not provide transportation services. All drivers are family members designated by the account holder.

• You must be at least 18 years old to create or administer a FamRide family account.
• Kid profiles may only be created by a parent or legal guardian on behalf of a minor.
• Driver profiles must be assigned to individuals who hold a valid driver's license and are legally permitted to operate a motor vehicle in their jurisdiction.
• By creating an account, you represent and warrant that you meet these eligibility requirements.

You are responsible for maintaining the confidentiality of your account credentials and all family profile PINs. You are solely responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or security breach. FamRight LLC shall not be liable for any loss or damage arising from your failure to protect your account credentials.

By using FamRide and providing your contact information, you consent to receive communications from FamRight LLC related to your use of the App, including:

• Email notifications: Ride status updates, ride assignments, and service-related communications sent to the email address associated with your profile.
• SMS/Text messages: By providing your mobile phone number and enabling SMS notifications, you expressly consent to receive automated transactional text messages regarding ride requests, assignments, pickups, completions, and cancellations.

SMS Terms:

• Message frequency varies based on ride activity
• Message and data rates may apply — check with your carrier
• Reply STOP to opt out of text messages at any time
• Reply HELP for support information
• SMS opt-out does not affect email notifications or your ability to use FamRide
• Carriers are not liable for delayed or undelivered messages
• We will never send marketing or promotional text messages

You may also manage your notification preferences (email and SMS) at any time through your family member profile settings within the App.

You agree to use FamRide only for lawful, private family ride coordination purposes. You agree NOT to:

• Use FamRide for commercial transportation, rideshare, or for-hire purposes
• Allow unauthorized individuals to access or use a family profile
• Provide false or misleading information about ride locations, family members, or your identity
• Use the App to facilitate any illegal activity
• Attempt to reverse-engineer, decompile, hack, or compromise the FamRide platform or its security
• Interfere with or disrupt the App's functionality or infrastructure
• Use automated systems (bots, scrapers) to access the App

FamRide is a coordination tool — it does not operate vehicles, employ drivers, or provide transportation services. All rides are arranged and conducted between family members at their own discretion and risk. By using FamRide, you acknowledge and agree that:

• FamRight LLC is not responsible for the actions, conduct, or negligence of any driver, passenger, or family member
• Drivers are solely responsible for operating their vehicles safely and in compliance with all applicable traffic laws and regulations
• FamRight LLC does not carry commercial auto, general liability, or passenger insurance — your personal auto insurance policy applies to all rides
• Parents and guardians are solely responsible for ensuring that designated drivers are qualified, licensed, insured, and safe
• You assume all risk associated with rides coordinated through FamRide

The brownie points program is a family-managed incentive feature within FamRide. Points are awarded as follows:

• 1 point per mile for parent-requested (mandatory) rides
• 2 points per mile for kid-requested (optional) rides

Brownie points have no cash value and are not redeemable for currency. Every 100 points equals an approximate $5 suggested family reward, but the actual terms, amounts, and fulfillment of any rewards are entirely at the discretion of the parent or guardian. FamRight LLC is not responsible for the fulfillment, payment, or honoring of any rewards.

By using FamRide as a driver, you consent to your real-time GPS location being collected and shared with family members during an active ride. Location sharing is limited to the duration of each ride and ceases immediately upon ride completion or cancellation. You may disable location permissions on your device, but this will limit real-time tracking features. See our Privacy Notice for additional details.

All FamRide and FamRight LLC branding, logos, software, design, and content are the exclusive property of FamRight LLC and its licensors, protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of any part of the App without express written permission from FamRight LLC.

FamRide integrates with third-party services (including but not limited to Twilio for SMS messaging, mapping providers, and analytics services) to deliver its functionality. FamRight LLC is not responsible for the availability, accuracy, or content of third-party services. Your use of such services is subject to their respective terms and privacy policies.

FAMRIDE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FAMRIGHT LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS. YOUR USE OF FAMRIDE IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FAMRIGHT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, FAMRIDE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. IN NO EVENT SHALL FAMRIGHT LLC'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless FamRight LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of FamRide; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any ride conducted through the platform; or (e) your violation of any third party's rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or FamRide shall first be attempted to be resolved through informal negotiation by contacting us at support@famright.com. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through binding arbitration or in the courts as described below.

FamRight LLC reserves the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of FamRide after any changes constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must discontinue use of the App.

FamRight LLC reserves the right to suspend or terminate your access to FamRide at any time, with or without notice, for violation of these Terms, misuse of the platform, or for any other reason at our sole discretion. You may delete your family account and all associated data at any time from the Manage Family screen within the App. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in the State of Georgia.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Notice, constitute the entire agreement between you and FamRight LLC regarding your use of FamRide and supersede all prior agreements, understandings, and representations.
